Elements that Must Be Proven to Establish Negligence
The rule of negligence is a law that requires individuals or a group of individuals to
conform to set standards or requirements (Stoyanova, 2020). Failure to conform to the stipulated
requirements or standards amounts to negligence, resulting in harm and hence subject to
prosecution. One of the elements that need to be proven is the legal duty of care to the plaintiff to
