This is a case between Anthony Thom and Jonathan Quick of Sun Vacations Inc. Quick
hired Thom to create a computer program that will help the organization maintain its cash
receipts, inventories, figures, and other data records. During the hiring process, no agreement
was made as to who owns the program being developed. Thom did most of the work despite
quickly providing instructions on what kind of program needed to be developed. While working
for Quick, he never received any employee benefits, and his social security taxes were remitted.
After some time, Thom terminated his contract after Quick violated the hourly oral agreement
and thus demanded compensation of about $14,560 for Sun’s use of the program called
CRISOD. However, Quick refused to compensate him unless he revoked the ownership rights of
the program. The big question is on who owns the program.
