In the state of Arizona, there is a ban on discrimination based on lawful behaviors conducted
outside of the job, which includes smoking tobacco. Employers cannot refuse to hire someone
only since they are a smoker. (Perrone, 2019) Companies could be enabled to circumvent antidiscrimination legislation in some jurisdictions if being a nonsmoker is a required quality for
particular employment. In terms of privacy laws in the state, no law prohibits the employer from
monitoring smoking habits. This legislation suggests that employers retain the right to monitor
their workers’ conduct, which may include smoking, according to the terms of the law. In
addition, it is important to highlight that although federal privacy legislation bans monitoring
workers outside of work since it involves sensitive information, employers have the right to
monitor their employees’ smoking habits, particularly at their place of employment.
The SSAA does not restrict employers’ ability to test current or potential workers for marijuana
